Terms of Use

YourSecret.org and the YourSecret mobile application are developed, owned, and operated exclusively by Farnora Limited (Ireland). These Terms apply to all individuals accessing and using the Service within the United States of America.

Our rules strictly govern every individual who accesses the platform. If you do not agree with any part of these Terms, you are prohibited from using the platform and must delete the application immediately. YourSecret promotes secure, private interactions; users are strictly encouraged and expected never to share personally identifiable information within any private or community interaction zones.

You must be at least eighteen (18) years old to access the system, complete our onboarding, or use YourSecret. By interacting with the Service, you represent and warrant that you are of legal age to form a binding contract and fully meet this eligibility requirement. If you do not meet this age requirement, you must immediately cease using the platform and delete the application from your device.

We reserve the right to update these Terms periodically to reflect changing regulatory, legal, or technical environments. Material updates will be announced within the application interface, via website notices, or via email notification (where applicable). Your continued use of the platform following the posting of changes constitutes explicit acceptance of the updated Terms.

By interacting with YourSecret, you agree to use the platform strictly for lawful, non-commercial, and mindful purposes, such as confidential text-based expression, emotional reflection, and structured peer support.

You explicitly agree to:

• Follow our comprehensive Community Guidelines at all times.
• Maintain the absolute confidentiality of your system-generated anonymous identifiers or masks.
• Assume complete, sole civil and legal liability for any text, inputs, or thoughts you submit.

We encourage users to report any violations of these Terms using our dedicated in-app reporting tools (by tapping the … icon next to any interaction) or by emailing us directly at support@yoursecret.org.

YourSecret reserves the right to suspend, restrict, or permanently ban any anonymous account or mask that violates these Terms without prior notice or liability.

1. Algorithmic Matching (The Brain Engine) and Text Isolation

YourSecret operates as an interactive computer system designed for text-based peer connection. To facilitate safe communication, our automated software engine (the “Brain” engine) programmatically converts your private inputs and thoughts into abstract mathematical vector embeddings and numerical tokens. You explicitly acknowledge and agree to the following system mechanics:

• Privacy-by-Design Vectorization: Even if an input contains specific text, descriptions, or names, the system immediately tokenizes and processes it into irreversible mathematical vectors. Your raw text thoughts and any entered strings remain confidential, are never published on an open feed, and are never shared (except when transferred to AI services for the purpose of vectorization), transmitted, or displayed to the other user, even after a connection is established. Your raw text thoughts are stored on our operational production servers in an unencrypted or human-readable text format only for a short period, until the moment of vectorization.
• No Context Transfer: The Brain engine operates solely to programmatically generate an abstract compatibility percentage to enable a private peer support space invitation. Once an invitation is accepted, users enter an isolated, private 1-on-1 text room. This room starts as a complete blank canvas. The platform does not transfer, display, or attach your original input text, the matching context, or the trigger keywords into the chat session.
• Lifecycle and Retention: Once inside the isolated 1-on-1 space, messages are transmitted to facilitate real-time user communication (without further vector conversion). To maximize user privacy, each active session automatically expires and is completely cleared from the user interface within twenty-four (24) hours. To ensure community safety and allow for standard operational processing, the underlying ephemeral text data undergoes a scheduled maintenance cycle and is completely, permanently, and irreversibly deleted from the entire YourSecret network within a maximum of thirty (30) days. The platform does not actively monitor private chat logs, and the sole legal and civil responsibility for the content of these communications rests exclusively with the participating users.

2. Submission of Third-Party Personal Identifiers

The Service is strictly designed for sharing abstract emotions, daily reflections, and seeking peer support. If you choose to include specific real-world identifiers of third parties (such as first and last names, employer/company names, physical addresses, or vehicle license plates) to find specific connections (e.g., searching for mutual viewpoints or parties involved in a personal dispute), the system can or may halt the process and display a mandatory Privacy Warning.

3. Explicit Assumption of Risk and Strict Civil Liability

By bypassing the Privacy Warning, overriding the warning screen, and selecting “Start searching”, you explicitly acknowledge, certify, and agree that:

• You assume full personal, civil, and financial legal liability for any real-world consequences, claims, or damages arising from your submission, including but not limited to defamation (libel/slander), cyberstalking, harassment, intentional infliction of emotional distress, or breach of privacy under U.S. federal and state laws (including the California Consumer Privacy Act - CCPA).
• YourSecret acts strictly as a passive interactive computer service provider under Section 230 of the Communications Decency Act. Because all inputs are programmatically vectorized and tokenized without human intervention, initial moderation is performed by AI. We do not involve humans to verify or endorse content, do not moderate for factual accuracy, and assume no responsibility for user-submitted personal identifiers. You are the sole publisher and author of your content.
• You certify that your intent is strictly to seek mutual communication or psychological resolution, and never to coordinate physical harm, vandalism, retaliation, public doxxing, or any illegal acts against any individual.

3.1. User-Generated Content (UGC)
You retain ownership of any content, reflections, or thoughts that you submit to YourSecret. You grant us a limited, worldwide license to host, encode, and moderate this content solely for operating, securing, and maintaining the platform.

3.2. Moderation Rights
YourSecret reserves the right to remove any content, including an anonymous message or temporary input, that violates these Terms or our Community Guidelines.

3.3. No Obligation to Monitor
We are not obligated to actively monitor all user activity, inputs, or private text content. However, we may monitor, preserve, and disclose content if required by law or in a good faith belief that such action is necessary to:

• Comply with legal obligations or valid judicial orders
• Respond to lawful requests from U.S. federal or state authorities
• Protect the immediate safety, rights, and integrity of the platform, its codebase, and its users

3.4. Section 230 Disclaimer & Algorithmic Neutrality (U.S. Law)
In accordance with Section 230 of the Communications Decency Act, YourSecret is not liable for user-generated content, thoughts, or private messages. You explicitly acknowledge and agree that the automated generation of vector matches and numerical tokens by the Brain engine does not constitute editorial creation, human curation, or endorsement of content by the platform. YourSecret acts strictly as a technologically neutral intermediary, and the sole legal and civil responsibility for the context, intent, and consequences of any generated match or subsequent private communication remains exclusively with the user.

4.1. Disclaimer of Warranties
YourSecret is provided on an “as is” and “as available” basis. We do not guarantee that the application or web services will be error-free, secure at all times, or uninterrupted.

4.2. Limitation of Liability
To the maximum extent permitted by applicable law, Farnora Limited (Ireland) and its affiliates shall not be liable for any indirect, incidental, punitive, special, or consequential damages. Our total aggregated liability shall not exceed $100 USD or the amount paid by you (if any) to use the platform in the past twelve (12) months.

4.3. Indemnification
You agree to indemnify, defend, and hold harmless YourSecret, Farnora Limited, and its operational team from any claims, legal actions, losses, or demands arising from your violation of these Terms or infringement of third-party privacy rights.

4.4. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Ireland. However, we fully respect and uphold the privacy, digital safety, and consumer protection standards expected by our users across the United States.

4.5. Termination
We may suspend or terminate your access to the platform at any time, with or without notice, for violations of these Terms, community disruption, or applicable law.
